Nature of the Goods Statement

This Nature of the Goods Statement forms one part of the All Things RC Terms and Conditions and may be amended at any time without prior notice.  Such changes shall take effect in respect of all subsequent uses of the Website and orders placed with us – you should check the Website for changes to this Policy each time before you use the Website or place an order, and proceed only if you accept the terms.

Any reference in this Nature of the Goods Statement to ‘our’, ‘us’ and ‘we’ refers to All Things RC ABN 43 983 218 303, and ‘the Website’ refers to www.allthingsrc.com.au.

General Nature of Remote Control Goods

Many of the Goods (Products) supplied by us have the potential to travel at high speed on the ground, in the air and/or on water and may use volatile battery or fuel power sources.  When using remote controlled or other unmanned products (Remote Control Products) there is a risk of damage to the Product (a crash is almost inevitable to occur during operation at some point) or other property, or injury to persons or other living things.

Unless we specifically describe a product as a ‘toy’ all Products sold by us are not toys and should be operated only by persons of a suitable age and skill level as recommended by the manufacturer (usually 16+ years of age) and who have at least a basic understanding of the mechanics of the Product.  We do not sell to children.  If you are under 18, you may use the Website only with involvement and supervision of a parent or guardian.  We assume that anyone using this site or has placed an order is either over the age of 18 years or is using it with the involvement, permission and supervision of a parent or guardian.

Assembly and safe operation of Remote Control Products is your responsibility and you should take suitable safety precautions.  Assembly should be completed out of reach of children.  Always read the instruction manual and any other manufacturer documentation prior to assembly, starting the engine, applying power and general operation of the Product and keep such documents ready at hand for quick reference.  Failure to do so may result in damage and make the Product unsafe.

Many factors outside of our control may cause or substantially contribute to: products becoming unsafe or weak; a defect, damage or injury; reduced performance or durability of the Product; or increase the potential to crash or lose control of the Product.  In most cases where factors outside of our control have occurred and in the event of any type of crash, it can be very difficult, if not impossible, for us or the manufacturer (or Australian distributor or authorised agent) to determine whether an issue was caused or substantially contributed to by a failure of the Product, from operator error or some other factor that was outside of our control.

Should factors outside of our control occur it may result in you not being able to rely on certain remedies under warranty or Australian Consumer Law (Consumer Guarantees) - in particular that the Products are of acceptable quality, are safe, durable and free from defects.  Factors outside of our control include, but are not limited to:

  • Incorrect or defective assembly or installation by persons other than authorised staff or agents of All Things RC.
  • Maintenance, repairs, tuning, gearing, programming of programmable components in a manner that is contrary to any instruction or recommendation of the manufacturer, whether completed by All Things RC at your explicit request or by other persons.
  • Any alterations or modifications, including addition or removal, of any components or parts whether completed by All Things RC at your explicit request or by other persons.
  • Use of consumables, such as fuel, tyres and propellers, that are contrary to any instruction or recommendation of the manufacturer, whether completed by All Things RC at your explicit request or by other persons.
  • Use of the Goods after an initial low speed and/or low height test drive or flight – we have no control over the ability of the operator nor the acceleration, steering, braking and general manoeuvrable style used by the operator.
  • Storage of Products in poor or unsuitable environments.
  • All forms of neglect, misuse or excessive use of Products.
  • Not following any instruction provided by the manufacturer.
  • Not following the Battery Safety Precautions.
  • Battery swelling, puffing or bulging.

It is your responsibility to ensure safe use, storage and charging of the Product.

Battery Safety Precautions

Remote Control Products often involve dealing with rechargeable batteries - which are not the same as household batteries.  They are not intended for normal household use and require additional precautions, such as:

  • Never allow children to handle or recharge batteries and electrical items.
  • Ensure you use the correct charger for your battery and follow all manufacturer instructions for the battery, charger and any other battery related Products.
  • Always recharge batteries in a fire-safe, cool and well-ventilated area.
  • Pay attention and watch for warning signs that something may be wrong with your battery, such as, uneven cell voltages, excessive heat, swelling, puffing and bulging.
  • Stop charging and/or using batteries and chargers if you think something may be wrong.
  • Recharging should always be supervised - never leave recharging batteries unattended or overnight.
  • Store batteries in a fire safe place such as a fire safe bag in a concrete area, and ensure terminals cannot short out.
  • Do not overcharge or discharge the battery beyond safe levels.
  • Do not store in a fully charged or fully discharged / flat state for extended periods of time.
  • Do not leave the battery connected to the vehicle for extended periods of time - it will likely drain the battery flat beyond what is safe.
  • Do not leave fully charged batteries connected to a charger - once a battery is fully charged, disconnect it from the charger.

Not following these precautions may lead to damage to the battery, damage to Products, fire or serious injury!  You will be solely responsible for complying with these safety precautions and the general safe use, handling, storage and care of all batteries purchased (or otherwise received from us, such as, in the case of a free gift or competition prize).  To the maximum effect permitted by law, damages, fires, injuries or otherwise will not be covered in any way by us, nor shall we be held responsible for any such faults, failures or otherwise.

If you are unable to strictly follow the Battery Safety Precautions and any outlined by the manufacturer of such Products, please restrict your purchase of battery operated Products that involve AA or AAA batteries only.

Nitro or Petrol Power Systems

Goods that use nitro or petrol power systems often require a level of adjustment, tuning and troubleshooting.  We recommend them for intermediate and advanced users only.  Mechanical knowledge and experience varies amongst hobbyists, the adjustment and tuning of nitro or gas powered products is not covered under warranty as it is not a manufacturing fault.  Many of the Products we sell come with instructions and guidelines for tuning – failure to follow such instructions will void warranty and may also reduce your ability to claim certain remedies under Consumer Guarantees.  You may contact us if you need assistance to tune or adjust your product.

Limitation of Liability

It is your responsibility to ensure safe use, storage and charging of the Product.  To the maximum effect permitted by law, we assume no liability or responsibility for any injury, damage, or failure associated with the use, storage or charging of any Product, nor will we assume any losses for such failures.  If any liability is not able to be excluded by law we limit our liability to the price paid for the Product.

You agree to indemnify All Things RC from all damages, losses, penalties, fines, expenses and costs (including legal costs) which arise out of or relate to your use of any product supplied by us.  This indemnification includes, without limitation, liability relating to loss, damage or injury resulting from factors outside of our control.

Certain laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages.  If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.

Ordering Policy

Any reference in this Ordering Policy to ‘our’, ‘us’ and ‘we’ refers to All Things RC ABN 43 983 218 303, ‘the Website’ refers to www.allthingsrc.com.au and ‘business day’ refers to any Monday, Tuesday, Wednesday, Thursday or Friday that is not a public holiday in New South Wales, Australia and where we have not expressly noted on the Website that we will be closed for trading on that day.

Stock Availability Status

In-Stock
We physically have the Product in our warehouse ready to fulfil your order.  In Stock items are shown on the Website when the quantity of 1 or more is displayed.
Almost Here
means that we do not physically have the Product, but we have an order with our supplier which is in transit and we expect to receive it in the next 1 to 3 business days.
3-10 days
We do not physically have the Product, but once your order and cleared payment is received the Product will be added to our next supplier order (which is generally on Monday each week).  Products that we classify as ‘3-10 days’ will generally be received by us in 3 to 10 business days after we place our order with the supplier.  If you require the item for a specific date, please contact us by email or phone and we can advise an estimated availability date once we have placed the order with our supplier.
1-4 weeks
We do not physically have the Product, but it will be ordered from our supplier once your order and cleared payment is received, unless there is a minimum order quantity with our supplier, in which case the Product will be added to our next order with that supplier and we will keep you updated on the progress.  Products that we classify as ‘1-4 weeks’ will generally be received by us in 1 to 4 weeks after we place our order with the supplier.  If you require the item for a specific date, please contact us by email or phone and we can advise an estimated availability date once we have placed the order with our supplier.
Built to Order
The Product is built on receipt of your order and cleared payment.  Please allow 5-10 business days for us to build the Product.
Backorder
We do not physically have the Product, though it is currently on order from our supplier, but they are temporarily out of stock and we generally do not have an estimated time for arrival.  If you require the item for a specific date, please contact us by email or phone and we can advise if we have an estimated availability date at that time.  You may cancel your order for a Backorder Product at any time until we have received the Product and the Cancellation Fee will be waived.  We will contact you by email or phone once we have received the Product and confirm if you wish to proceed or cancel your order.
Pre-Order
The Product is a new product awaiting release and delivery to us.  Pre-Order Products will be subject to estimated pricing, which may be changed at any time without prior notice.  Pre-Order Products will be available for order fulfilment on or shortly after the Product release date.  You may pre-order quantities of more than one, but to make the process fair for all of our customers, we fill orders for one unit per customer and then fill second and subsequent units if we have sufficient stock.  If you require the item for a specific date, please contact us by email or phone and we can advise an estimated availability date based on the release information we have at that time.  You may cancel your order for a Pre-Order Product at any time until the Product release date and the Cancellation Fee will be waived.  We will contact you by email or phone shortly before the Product release date to confirm if you wish to proceed or cancel your order.
Accepting Orders
We are currently taking orders for the Product and once we reach a sufficient order level we will place a bulk order with the supplier.  You may contact us by email or phone at any time to find out the status of our bulk order.  You may cancel your order for Accepting Orders Products at any time until we have reached the sufficient order level and the Cancellation Fee will be waived.
Out of Stock
We do not physically have the Product, our supplier is also out of stock and we do not want to accept payment for products on which we cannot give you an estimated availability time.  If there is a product that is not available for order, but you would like to purchase it, please click ‘notify me’ and enter your name and email address – if the ‘notify me’ option is not available you may contact us by email or phone to register your interest in the Product.  As soon as the product becomes available for you to order we will alert you, and you will have the opportunity to purchase the Product at the current price at that time.  In the event we have encountered a system error and you have submitted an order for an ‘Out of Stock’ Product we will contact you by email or phone to discuss the unavailability of the Product and your options, such as a refund of your money – the Cancellation Fee will be waived for any orders cancelled and refunded for ‘Out of Stock’ Products.
Discontinued
We do not have the product and it is no longer available for order because either we no longer carry the product, our supplier no longer carries the product, or the manufacturer has decided to no longer produce the product.  In the event you have submitted an order for a ‘Discontinued’ Product we will contact you by email or phone to discuss the unavailability of the Product and your available options, such as a refund of your money – the Cancellation Fee will be waived for any orders cancelled and refunded for ‘Discontinued’ Products.

Placing an Order

You may place an order (Order) by completing the Checkout process on the Website and clicking the ‘Confirm Order’ button, or via other means, such as phone, email, eBay website or Gumtree website, which will have the same effect and terms as ordering online, the only difference is that we will create an account for you, if you do not already have one, and enter the order into the system on your behalf.  When you place an Order, we will issue you with an Order Number via email.  By placing an Order, you make an offer to us to purchase the Products you have selected and agree to be bound by this Ordering Policy and the greater Terms.  Orders will only be attended to once we have confirmed receipt of cleared funds.

If you place your Order through the Website (or we did on your behalf, such as in the case for email and phone orders) you will receive an automated email to confirm your Order was successfully submitted.  Once we have received the cleared funds we will send you an email notifying you of this (unless we anticipate dispatching your Order on the same day).  Your Order is formally accepted once we advise you by email that your Order is ready for dispatch.  If we cannot process or accept your Order after payment is received we will contact you by email or phone to discuss your options, such as a refund.  We reserve the right to refuse service, terminate accounts, remove or edit content, or to modify or cancel orders at our sole discretion at any time without prior notice.

We do not sell to children.  If you are under 18, you may use the Website or place an order only with involvement and supervision of a parent or guardian.  We assume that anyone using this site or has placed an order is either over the age of 18 years or is using it with the involvement, permission and supervision of a parent or guardian.

To assist in protecting us from fraudulent activities we may request additional documentation, such as your driver’s license so that we can identify you.  These documents will only be used for the purpose in which you have provided them, which is to verify your identity.

Order Payment

We offer PayPal and Direct Deposit payment methods.  Order processing will not commence until we have received full and cleared payment.

PayPal gives you the option of using a PayPal account or any Australian credit or debit card to pay for your order.

If you select the direct deposit payment method, it is important that you include the Order Number as the reference number when depositing money.  Otherwise, we may not be able to match the deposit with your transaction and it will delay the processing of your order.  Once your full and cleared payment is received and matched to your order we will commence processing of your order.  Please allow 2-3 business days for your funds to be received and matched in our bank account.

Full payment must be received within 7 days from the date that you place your order, otherwise we may cancel the transaction and charge you the Cancelation Fee.

Stock Availability Discrepancies

On rare occasions we may experience discrepancies with our stock availability and may not physically have a Product in-stock or may no longer be able to source the Product.  If we encounter a stock discrepancy that affects your order we will contact you as soon as possible by email or phone to discuss either a refund of the purchase price you paid, alternative product, how long it will take for the item to become available and if you wish to cancel your order.  If you choose to cancel an order as a result of a stock availability discrepancy the Cancellation Fee will be waived.  We accept no liability for any claims or damages whatsoever in the event of the unavailability or delay of products displayed on the Website or any other medium.

Product Variations

The product description and images are correct to the best of our knowledge at the time of writing. However, the manufacturer may choose at any time to vary individual components to make a product so we are able to guarantee that the product supplied will be substantially the same, but may include some variations. Product variations may be visual in nature, such as different colour or design of the body, paint, wheels, propellers or engine, or technical in nature with components like engines and exhaust systems which may have undergone changes to improve strength, performance or for other reasons.

Order Fulfilment Delays

If we encounter unforseen delays we will contact you by email or phone to discuss the delay.  We accept no liability for any claims or damages whatsoever in the event of the unavailability or delay of products displayed on the Website or any other medium.  Cancellation of orders due to unforseen or reasonable Order Fulfilment Delays will have the Cancellation Fee applied – only in the event of extensive and unreasonable delays will the Cancellation Fee be waived.

Order Cancellation

Unless a specific clause elsewhere in this Ordering Policy or the greater Terms applies:

  • You may cancel an Order up until the Order Dispatch process has commenced.
  • All cancelled orders, whether cancelled by you or us, will incur a 5% Cancellation Fee on the purchase price of each Product item cancelled in an Order.

The Cancellation Fee applies because there are costs that we will have already incurred which we are not always able to recoup if you cancel your order.  Such costs include higher supply costs to place small or single item orders with our suppliers, merchant processing fees and administration costs related to your order.

We reserve the right to modify, cancel or decline any Order at any given time.

Cancelled Lay-by orders will incur the relevant Termination Fee that applies to the selected lay-by plan in place of this Cancellation Fee. 

International Orders

For shipments to international destinations (outside of Australia), so long as your delivery address entered at checkout is outside of Australia you will not be charged the Australian Goods and Services Tax (GST). If you are logged in and have an international address on your account you will already see the excluding GST prices.

Delivery Policy

Shipping Options

At All Things RC we want you to receive your Products as quickly as possible, but most importantly in their original condition and working order, so we recommend that you select ‘Parcel Post with Signature and Insurance’ as the delivery method.

Where the delivery option you have chosen is not able to be carried out, or is inappropriate for the selected products, such as in the case of dangerous or oversized Products, we will contact you by email or phone to discuss your options and any additional delivery costs.  We reserve the right to cancel an order or alter the delivery method if we deem the chosen delivery method is not appropriate to ensure the parcel arrives in an acceptable condition or is against the law.

Delivery costs are based on the combined weight of the Products ordered or cubic weight for large items.  We aim to deliver excellent product pricing for our customers, consequently we are unable to offer free or flat rate shipping.

Dangerous Goods

Safety regulations prohibit some hobby products from being transported by air and must be shipped by road transport.  These include highly flammable and potentially explosive substances, such as: Lithium Polymer (LiPo) batteries, fuel, spray cans, compressed air cans and some glues and thinners.  If there are any additional charges for your order as a result of transporting dangerous goods we will contact you by email or phone.  Delivery times for Orders containing dangerous goods will take a little longer to get you, generally up to 2 weeks.

Order Dispatch and Tracking

Orders are generally processed within 3 business days and dispatched on the next Monday, Wednesday or Friday. Please note that purchasing Express Post options will not affect our processing and dispatch time.

Upon dispatch of your order we will send you an email notifying you that your order is on its way and if applicable, supply you with the tracking reference for the delivery.

If you selected a delivery method with tracking capabilities you will need to refer to the relevant carrier’s website (e.g. Australia Post) to track your delivery.  You may contact us or the delivery provider directly to assist with tracking your delivery.  If your order is severely overdue please contact us by email or phone and provide your order number and we will make enquires to find out more information for you.

Order Arrival

The time it takes for you to receive your order, after we have dispatched it, will depend on the delivery schedule of the transport operator to your area.  If applicable, we encourage you to use the tracking number supplied so that you can stay informed of the progress for your delivery and also so that you can ensure someone is available at the delivery address to sign for your parcel.  If you are not home (or at the delivery address) at the time of delivery, your package will be available for collection from your local post office.

If your order is severely overdue please contact us by email or phone and provide your order number and where possible we will make enquires to find out more information for you.

Damaged in Transit and Missing Shipments

This section applies only if you selected a delivery option with additional cover for loss or damage.  If you did not select insurance for your order then we will be unable to accept any claims for loss or damage during transit.

If a package has been damaged in transit and it is apparent when the package arrives, please refuse the delivery and call us as soon as possible – failure to reject the delivery may be seen by the carrier as your acceptance of the Goods in their current ‘as is’ condition and you may no longer be able to seek a remedy under the loss and damage cover.  If you have already accepted a package and then discover that it has been damaged or is missing Products from your order, call us as soon as possible (please note that on occasion carriers may deliver orders over two or more different deliveries dependent on the size of the order).  If possible, please take photos of all sides of the damaged package and email them to us with your order number.  Be sure to keep all paperwork, packing material and wrapping with the damaged goods as the delivery carrier will likely want to inspect the package before processing the claim.

Where the delivery method you chose included signature on delivery and the package has been delivered without the driver/operator obtaining your signature, contact the carrier before opening the package.  The carrier will likely need to inspect the package and verify any damage before any claim will be accepted.

Please do not arrange and return Products Damaged in Transit.  Please contact us by email or phone and we will advise the steps that need to be taken.  Returning the Goods yourself may jeopardise your claim and prevent you from receiving a remedy.

Defects found after the product has been assembled or used in any way usually fall under manufacturer warranty or Consumer Guarantees where the Returns, Repair and Refund Policy applies.  Please contact us by email or phone if you are unsure which policy is appropriate for your situation.

Pick-up Policy

Any reference in this Pick-up Policy to ‘our’, ‘us’ and ‘we’ refers to All Things RC ABN 43 983 218 303, ‘the Website’ refers to www.allthingsrc.com.au and ‘business day’ refers to any Monday, Tuesday, Wednesday, Thursday or Friday that is not a public holiday in New South Wales, Australia and where we have not expressly noted on the Website that we will be closed for trading on that day.

At our sole discretion and subject to change without prior notice, we may provide a pick-up option for some Products.  The pick-up location is in Penrith (western Sydney). Please see our contact us page for our warehouse pick-up hours.

Orders are generally processed within 3 business days. Once your order has been processed we will send you a Ready for Pick-Up notification. If pick-up is not completed within 3 days after your Ready for Pick-Up confirmation is sent, you forfeit the hold on the products, your order will be cancelled and the products will be entered back into our available stock for sale to other customers.

This Pick-up Policy may be amended at any time without prior notice and such changes shall take effect in respect of all subsequent uses of the Website and orders placed by you or any other person.  You should therefore check this Pick-up Policy every time before you use the Website or make a purchase with us, and only if you accept these Terms should you proceed to access and use the Website or place an order with us.
